GENERAL SALES CONDITIONS

A - INTRODUCTION

These general sales conditions (hereinafter referred to as "General Conditions") govern the sale of products marketed by www.mysanity.it. All purchase contracts for products concluded through the website www.mysanity.it and according to the procedures indicated therein, between the seller and the customer, will be governed by these General Conditions.

B - ACCEPTANCE OF THE GENERAL SALES CONDITIONS

  1. The contract concluded between MySanity and the Customer shall be deemed concluded upon acceptance, even partial, of the order by MySanity, which reserves the right, at its sole discretion, to accept the order. Acceptance is deemed implicit if not otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general conditions and payment conditions transcribed below.
  2. If the Customer is a final consumer (i.e., a natural person who purchases goods for purposes not related to his/her professional activity), upon completion of the online purchase procedure, he/she shall print or save an electronic copy and, in any case, keep these general sales conditions, in compliance with the provisions of articles 3 and 4 of Legislative Decree no. 185/1999 on distance selling.
  3. Any right of the Customer to compensation for damages or indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance, even partial, of an order, is excluded.

C - PURCHASE PROCEDURE

  1. The Customer may only purchase products listed in MySanity's electronic catalog at the time of placing the order and viewable at the address (URL) www.mysanity.it, as described in the respective information sheets.
  2. The correct receipt of the order is confirmed by MySanity through an email response sent to the email address provided by the Customer. The message reproduces all the data entered by the Customer, who undertakes to verify their correctness and to promptly communicate any corrections, as described in this document.
  3. In case of non-acceptance of the order, MySanity undertakes to promptly notify the Customer using the same methods.
  4. All prices on the website are to be understood as retail prices, inclusive of VAT. MySanity reserves the right to change prices at any time without prior notice.

D - PAYMENT METHODS

MySanity accepts payments by the following methods:

  1. Bank transfer to the coordinates transmitted during the order. The reason for the transfer must always include the customer's name and surname, together with the order number, as indicated in the email received by the Customer following the purchase.
  2. Cash on delivery: payment will be made by the Customer upon receipt of the goods. Cash on delivery is only possible for shipments to Italy;
  3. Paypal, through one's own Paypal account or with a credit card;
  4. Satispay with one's own account;
  5. Stripe, an external platform for online payments that allows accepting payments with debit cards, prepaid cards, credit cards, and digital wallets.
  6. In cases of purchasing goods with credit card payment method, at no time during the purchase process is MySanity able to know the information relating to the buyer's credit card, as they are entered directly on the website of the banking institution that manages the transaction (with highly secure systems). No MySanity computer archive contains or stores such data. MySanity cannot therefore be held responsible for any fraudulent and improper use of credit cards by third parties, at the time of payment for products purchased on www.mysanity.it

E - ORDER CANCELLATION

In case of order cancellation, both by the Customer and in the event of non-acceptance by MySanity, the latter will simultaneously request the cancellation of the transaction and the release of the amount committed. Cancellation is possible until the goods are shipped. Release times, for certain types of cards, depend exclusively on the banking system and may extend up to their natural expiration (24th day from the authorization date). If the cancellation of the transaction is requested, in no case can MySanity be held responsible for any damages, direct or indirect, caused by delays in the non-release of the committed amount by the banking system.

F - DELIVERY METHODS AND COSTS

  1. Shipments are made exclusively via express courier. The courier makes the first delivery without notice. In case of absence of the Customer, the courier leaves a notice and attempts delivery again within 24 hours; in case of further absence, another notice is left and the customer is contacted by the courier for the third attempt. If this is also unsuccessful, the Customer will be contacted by MySanity to define the details of the delivery. If the fourth attempt also fails, the goods will be returned to MySanity, with consequent cancellation of the order and nothing will be owed to the Customer.
  2. For the issuance of the invoice, it is essential to provide the tax code and/or VAT number, the information provided by the Customer at the time of the order shall prevail.
  3. Shipping and delivery costs are borne by the Customer and are explicitly highlighted at the time of placing the order. Payment for the goods by the Customer will be made using the chosen method at the time of the order. No additional charges or commissions are due to MySanity.
  4. Delivery of purchased products usually takes place within 2 working days (for deliveries to Italy); they may vary due to force majeure or due to traffic conditions and road conditions in general or by act of Authority.
  5. No liability can be attributed to MySanity in case of delay in order processing or delivery of ordered goods.
  6. Upon delivery of the goods by the courier, the Customer is required to check:
    - that the number of packages delivered corresponds to what is indicated on the invoice;
    - that the packaging is intact, not damaged, wet, or altered in any way, including sealing materials (adhesive tape or metal straps).
    Any damage or non-compliance of the number of packages or indications must be immediately contested to the courier making the delivery, by affixing the wording "withdrawal with reservation" on the accompanying document and confirmed within two days via email.
    Even with intact packaging, the goods must be checked by the Customer within two days of receipt. Any hidden anomalies must be reported in writing by email. Any reports beyond the aforementioned deadlines will not be considered. The Customer assumes full responsibility for any declarations made. Once the courier's document is signed, the Customer cannot make any complaints regarding the external characteristics of what has been delivered.

G - RIGHT OF WITHDRAWAL

  1. Pursuant to Legislative Decree no. 185/99, concerning the protection of consumers in contracts concluded at a distance, the Customer has the right to withdraw from the purchase of the received goods/services within 14 working days from the delivery of the goods or from the conclusion of the contract in the case of service supply.
  2. The withdrawal must be exercised by sending a written communication to the address shop@mysanity.it expressing the intention to withdraw from the concluded contract.
  3. If the Customer exercises the right of withdrawal, he/she must also bear the costs for the return of the UNUSED and INTACT goods in their original packaging to the following address: Mysanity - Via Clivio 43, 21059 Viggiù (VA).
  4. The return must be made within and not later than 15 days from the date of receipt of the item with postage paid (the shipping date shall prevail). Parcels sent cash on delivery or with assigned postage will not be collected under any circumstances.
  5. At this point, if the right of withdrawal has been exercised by the Customer according to these instructions, MySanity will refund the Customer, within a maximum period of 15 days from the receipt of his communication, the amount paid for the purchase of the goods, net of shipping costs.
